Terms of Service

1. Introduction

OutletRX’s services help you coordinate and communicate with a health care provider. They do not replace your relationship with your own physician and may not be right for every condition. If you have a medical emergency, call your doctor or dial 911 immediately. These Terms of Service ("Terms") are a binding agreement between you and Honest Ventures LLC, doing business as OutletRX ("OutletRX," "we," "us," or "our"), governing your use of outletrx.com, its subdomains, and any affiliated app (together, the "Sites") and the services offered through them (the "Services"). By accessing or using the Sites or Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Sites or Services. We may update these Terms; changes take effect when posted, and your continued use means you accept them.

OutletRX is a technology platform and does not provide medical care. Health care services are provided by independent licensed medical providers. Using the Services does not create a provider-patient relationship with OutletRX. Except for communications from your provider, nothing on the Sites is medical advice.

2. Eligibility, telehealth consent, and your account

To use the Services you must be at least 18 years old, located in a state where the Services are offered, and able to agree to these Terms. Meeting these requirements does not guarantee you will be approved for or receive any Service.

Telehealth consent

Telemedicine delivers health care through electronic communications when you and your provider are in different locations. By using the Services, you consent to receive care this way and acknowledge its limitations: a provider may not have the information an in-person exam would provide and may be limited by state law in what can be prescribed without one. Any separate telehealth consent presented during your visit also applies.

Your account

You agree to provide accurate, complete information and to keep it current. You are responsible for all activity under your account and for keeping your password confidential. Do not share your account or create more than one. Notify us promptly of unauthorized use through our contact page. We may suspend or terminate your account if necessary.

3. Communications

By providing your number or opting in, you consent to transactional and, where you opt in, marketing messages from OutletRX about your account and the Services. Message and data rates may apply. You can opt out of texts at any time by replying STOP. Text and email are not encrypted and may be intercepted; if you choose to send or receive health or other sensitive information this way, you do so at your own risk. Consent to marketing messages is not a condition of using the Services.

4. Payment and pharmacy services

Payment

You agree to pay the fees disclosed for Services you request and authorize applicable payment processors to charge your payment method. Payments may include fees collected on behalf of health care organizations or providers. Insurance coverage and reimbursement vary; check the applicable offer and your plan before purchasing. If you enroll in a recurring offering, its disclosed billing and cancellation terms apply, subject to applicable law.

Pharmacy services

If a provider issues a prescription, you may choose an eligible pharmacy to fill it, subject to applicable law and availability. You consent to information being shared with the dispensing pharmacy as needed to fulfill your prescription. Keep all medications out of the reach of children and follow the instructions provided by your prescriber and pharmacy.

5. Legal terms

Acceptable use

You may use the Sites only for your own personal, non-commercial use and in compliance with these Terms. You agree not to violate any law; infringe anyone’s rights; impersonate anyone; upload viruses or malicious code; reverse engineer, scrape, copy, resell, or build a competing or derivative product from the Sites; interfere with or attempt to gain unauthorized access to the Sites or their security; or remove proprietary notices. We may deny or suspend access for violations of these Terms.

Intellectual property

OutletRX or its licensors owns rights in the Sites and their content, features, and functionality, including trademarks, logos, and other materials. You may not copy, modify, distribute, publicly display, sell, or otherwise exploit any part of the Sites except as ordinarily permitted through their normal use. Feedback you provide may be used by us without restriction or compensation. Personal data you submit is handled under our Privacy Policy and applicable health-privacy laws.

Third-party links

The Sites may link to third-party websites we do not control. We are not responsible for their content, products, or practices, and your use of them is at your own risk.

Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HONEST VENTURES LLC AND ITS AFFILIATES, PROVIDERS, OFFICERS, EMPLOYEES, AND AGENTS DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. YOU USE THE SITES AND ANY INFORMATION OBTAINED THROUGH THEM AT YOUR OWN RISK.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER HONEST VENTURES LLC NOR ITS AFFILIATES, PROVIDERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO USE OF THE SITES OR SERVICES. WHERE LIABILITY CANNOT BE DISCLAIMED, IT IS LIMITED TO THE EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify and hold harmless Honest Ventures LLC, its affiliates, and their officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Sites, your violation of these Terms or any law, or your fraud or willful misconduct.

Termination

These Terms remain in effect while you use the Sites. You may stop using the Sites at any time. We may suspend or terminate your access for violations of these Terms. The provisions intended by their nature to survive termination, including the warranty disclaimer, limitation of liability, and indemnification, will survive.

Disputes

If you have a dispute concerning the Services, please contact us so we can try to resolve it. Applicable law governs any unresolved dispute.

Copyright notices

If you believe material on the Sites infringes your copyright, please contact us with the work and allegedly infringing material identified, your contact information, a good-faith statement, and a statement that the information in your notice is accurate and that you are authorized to act.
